Phoenix AZ, ROC Lawyer Navigating Clients Through ROC Claims

Contracting and real estate law can be extremely complex. Whether you are a licensed contractor or dealing with one, it is important to understand your rights and obligations under the law. Contractors are heavily regulated under the Arizona State Registrar of Contractors. When a licensed contractor is alleged to violate the law, they may be subject to a complaint filed with the Registrar. The Registrar will then investigate the claim and may take disciplinary action against the contractor if they find that the contractor has violated the law.

If you are a contractor who has been accused of violating the law, it is important to have experienced legal representation on your side. An attorney at Resolvere Law PLLC has experience representing contractors before the Registrar of Contractors. We can help you navigate the complaint process and assert your rights to protect you throughout the investigation.

What is the ROC?

The Registrar of Contractors is the state agency that licenses, regulates, and disciplines contractors in Arizona. The ROC is responsible for ensuring that all state contractors meet the minimum licensure requirements. They also investigate complaints against contractors and take disciplinary action when appropriate.

Arizona Registrar of Contractors Process

If the Arizona Registrar of Contractors receives a complaint against a contractor, they will open an investigation. During the investigation, they may request documents and information from the contractor. The contractor has the right to have an attorney represent them during this process.

Once the investigation is complete, the Registrar will make a determination as to whether or not there is enough evidence to prove that the contractor violated the law. If they find that the contractor did violate the law, they may take disciplinary action against the contractor. This could include issuing a fine, suspending or revoking the contractor’s license, or requiring the contractor to take corrective action.

If the ROC takes disciplinary action against a contractor, the contractor has the right to appeal that decision. The appeal will be heard by an administrative law judge who will review the evidence and determine whether or not the disciplinary action was appropriate.

If you are a contractor who is facing disciplinary action from the Arizona Registrar of Contractors, it is important to have experienced legal representation on your side to protect your contractor’s license from being revoked or suspended.

Why are ROC Claims Filed?

In most cases, ROC claims are filed by disgruntled customers who have complaints. Sometimes, the customer may feel that the contractor did not complete the work as promised. In other cases, the customer may be unhappy with the quality of the work, they may feel that the contractor delivered poor workmanship. In either case, the customer may file complaints with the Arizona Registrar of Contractors in an attempt to get their money back or to get the contractor to fix the problem.

Common mistakes made by contractors include:

  • Failing to obtain the necessary permits.
  • Failing to follow the building code.
  • Failing to properly supervise employees or subcontractors.
  • Using unlicensed workers.
  • Performing work without a contract.

At Resolvere Law PLLC, we have experience finding solutions for these types of disputes, and we look forward to resolving your issue promptly.
